This essay deals with the contemporary legal movement called law and economics. Accordingly, we sought to go a historical aspect of its base, which is usually exposed as one of its foundations, namely, the utilitarian philosophy; as well, we sought to clarify its current central foundation, wich establishes its northern operations, the wealth maximization. Between both issues, it was formed an opinion to recognize the political mismatch and, especially, democratic, between the principle of utility and the principle of wealth maximization.Downloads
